Terms of Service

Welcome to iWorka. By downloading, accessing, or using the iWorka mobile application or website (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
1. About iWorka
iWorka is a job-posting and work-sourcing platform that connects customers seeking services with independent workers who offer those services. iWorka operates as a marketplace and facilitator only.
2. Eligibility
- You must be at least 18 years old to use iWorka
- You must provide accurate, complete registration information
- You are responsible for maintaining the security of your account credentials
- One person may only hold one account
3. User Accounts
- Customers can browse workers, view profiles, subscribe for premium access, book workers, and communicate via in-app chat
- Workers can create a profile, list their skills and rates, receive bookings, and communicate with customers
- You are responsible for all activity that occurs under your account
- You may delete your account at any time — see our Account Deletion page
4. Platform Role & Limitations
iWorka provides the technology platform only. We:
- Do not employ, supervise, direct, or control any worker
- Do not guarantee the quality, safety, legality, or timeliness of any services
- Do not guarantee job availability, income, or working conditions for workers
- Do not perform background checks, criminal record checks, or skills assessments
- Do make best efforts to verify worker identities through ID submission
- Do facilitate community-driven ratings and reviews
- Do investigate reports of fraud, misconduct, or abuse
5. Customer Responsibilities
- Evaluate workers based on their profile, reviews, and ratings before booking
- Agree on scope, price, and timeline with the worker before work begins
- Treat workers with respect and dignity
- Provide a safe environment for workers performing services at your premises
- Pay all agreed amounts promptly
- Leave honest, fair reviews after each job
6. Worker Responsibilities
- You confirm you are an independent service provider, not an employee of iWorka
- Provide accurate information about your skills, experience, qualifications, and availability
- Deliver services professionally and to the agreed standard
- Arrange your own transport, tools, insurance, and safety equipment
- Comply with all applicable laws, including tax obligations (SARS), health and safety regulations, and municipal by-laws
- Maintain appropriate insurance for your trade if required by law
- Never misrepresent your qualifications or skills
7. Payments & Fees
- Premium subscription: R49/month for full platform access (clear photos, chat, bookings)
- Single worker unlock: R29 once-off per worker
- Service fee: A 10% platform fee is charged on bookings, paid by the customer
- All payments are processed securely by PayFast (PCI-DSS compliant). iWorka never stores credit card details
- Subscription payments are non-refundable once the billing period has started
- You may cancel your subscription at any time; access continues until the end of the current billing period
8. Reviews & Ratings
- Users may leave reviews and star ratings after a job is completed
- Reviews must be honest, fair, and based on actual experience
- Fake reviews, defamatory content, or review manipulation may result in account suspension
- iWorka reserves the right to remove reviews that violate these Terms
9. Prohibited Conduct
You may not:
- Use the Platform for any unlawful purpose
- Impersonate another person or provide false information
- Harass, threaten, or abuse other users
- Spam, solicit, or advertise outside services via the Platform
- Attempt to circumvent the Platform to avoid fees
- Reverse-engineer, scrape, or interfere with the Platform's operation
- Post content that is defamatory, obscene, discriminatory, or promotes violence
10. Limitation of Liability
- Services performed (or not performed) by workers found through the Platform
- Any loss, damage, injury, or theft occurring during or as a result of services
- Disputes between customers and workers
- Worker qualifications, conduct, or workmanship
- Working conditions, safety, or treatment of workers at customer premises
- Loss of data, revenue, or business opportunities
- Service interruptions or technical failures
iWorka's total liability to any user shall not exceed the amount paid by that user to iWorka in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless iWorka, its directors, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Services you provide or receive through the Platform
- Your violation of any law or the rights of a third party
12. Dispute Resolution
- Disputes between customers and workers should be resolved directly between the parties
- iWorka may, at its discretion, mediate disputes but is not obligated to do so
- Disputes with iWorka shall first be addressed through our contact form
- If unresolved, disputes shall be subject to mediation, then arbitration under the laws of the Republic of South Africa
13. Intellectual Property
All content, design, logos, and code on the Platform are the property of iWorka and are protected by South African and international copyright law. You may not copy, modify, or distribute any part of the Platform without written permission.
14. Account Suspension & Termination
- iWorka may suspend or permanently terminate any account that violates these Terms
- We may remove any content that violates these Terms or applicable law
- Repeated negative reviews or complaints may result in account review and possible removal
- You may delete your account at any time via the app or by contacting us
15. Modifications to Terms
We may update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Platform after changes constitutes acceptance of the new Terms.
16. Governing Law
These Terms are governed by the laws of the Republic of South Africa, including:
- Consumer Protection Act 68 of 2008 (CPA)
- Protection of Personal Information Act 4 of 2013 (POPIA)
- Electronic Communications and Transactions Act 25 of 2002 (ECTA)
